Public Domain in 2019
« on: February 08, 2016, 11:12:22 PM »

From what I have been reading online lately,it looks as if nothing new in the way of books movies and other material will become public domain until 2019 thats if companies like Disney dont get another extension. Am Curious, what new material may bcome public domain with comics in 2019 anybody know?...still waiting for TUROK to hit public domain.

Since they are copyright to a corporation it should be 95 years from first printing so 1923 becomes public domain.

The usual driving force for Congress extending copyright was Sonny Bono and after he died his wife. If she isn't still there then it is possible there won't be as much of a sense that something has to be done.

from Sooth:

"nice read on copyrights:
http://web.law.duke.edu/cspd/publicdomainday
so, in 2019, will DCM [and CB+) be ready to start hosting Gold Key books up to 1977
pretty much everything that was published between 1923 and 1977 will be public domain in 2019 if no new laws come in effect"

end quote

don't count on the big boys like Marvel/DC/Archie

but Gold Key , Dell, Harvey, Atlas (70s version), Skywald, Charlton, etc all the Dead publishers prob EC too, here's hoping. (EVERYTHING published up to 1977 is already PD in Canada and Europe) as of Jan 1, 2017

But,
in all likelihood the Mouse will bribe/extort every single member of both houses of congress as they have done in the past and achieve another 20 yr extension in the US

I do not believe there has been a definitive ruling on orphan works yet. Gold Key was bought and the properties are not in public domain. Harvey has been passed on as was Atlas recently so they can not be considered dead. DC owns EC rights. Charlton and ACG were bought by Boughton who published several books. This makes any of their books published after 1964  not in the public domain because of the retroactive ruling and they are not orphan works. Dell was bought by two entities the Penny Press and Random House neither of which claim their comic works. So any comics not renewed by their original licencor can be considered orphaned if a ruling ever comes down. I am not sure about Skywald, MF Enterprises and Milson.

I think the only EC work DC owns is Mad.  They're still tightly controlled and not in the PD, in any case.

Don't count on Sonny Bono's passing to help prevent further extension; we're going to need to fight on this one.  But it's one people have been getting ready for for quite a while.

And there is a new Sheriff in DC that does not cater to the special interests
