What's the copyright status on Atlas/Seaboard
« on: August 10, 2013, 11:49:50 PM »

Someone on another board was asking about this so I thought I would ask it here, since there are so many good minds on this board.

Checking wikipedia, I see that Martin Goodman's grandson, Jason Goodman, started up Atlas again in 2010. And at that time they were doing more of Grim Ghost, Phoenix and Wulf the Barbarian. I don't know what came of that.

But since Atlas/Seaboard granted ownership rights to the creators working for them (which is why so much talent came their way) do those creators still hold the rights? Or did those rights lapse?

Did Martin Goodman retain some ownership rights, as well? If his grandson could restart the company, you'd think the family must retain some copyright.

I wonder if the whole company is fractured under different copyright holders, if some is in the public domain or if it's all held by one owner.

Nothing created after 1967 will be in public domain in our lifetime. Thanks to Sonny Bono, and other politicians wanting to write books and such, copyright is based on the death of the creator and need not be renewed. So nothing by Atlas/S is in public domain.

I thought that was the case, but I wanted to be sure. Still, I wonder who holds the copyright on those characters--if they're each held by different creators--or if the copyright is shared.

Here is a blog post on that very subject.  I found it with a little googling.  Hope it helps:  http://ohdannyboy.blogspot.com/2012/01/who-really-owns-atlas-comics-not-jason.html
