Sheriff Wade was sure he had a case against a petty larceness named Jacobs. He claimed Jacobs had climbed a tree outside an unoccupied summer house and stolen some silver. He entered the second floor bedroom, the sheriff explained, and ransacked the place. The sheriff and I visited the scene. I reached up and examined some ripped ivy from the tree alongside the house. The sheriff said that's proof that Jacobs climbed the tree to enter the house. I suggested he had a very slim case, I'll explain why. In the case of the wrong robber, the second story window some 20 feet high had been entered. Yet I was able to reach the damaged ivy on the tree, and my reach is a mere 10 feet. The difference was enough to free an innocent man.
