Yoc, as much as I LOVE The Spirit and I LOVE seeing it online, I have to ask: Is it actually in the Public Domain?

Eisner was very protective of his properties (I know from personal experience dealing with him) and I have to believe his estate or whoever now owns the rights to The Spirit is just as protective. Has anyone vetted the rights to this strip/character?

When I looked, I didn't find any renewals for anything referring to the Spirit, and very few of the original inserts carry a copyright statement at all.  Granted, that's not 100% conclusive, for a variety of reasons, when it's every single issue over an extended period, the probability of a misfile is pretty low.

If anybody has an idea on where to look beyond "I think he would've done it," I'd be glad to hear it and check it out when I have time.  But based on the CCE renewals, if Eisner or his estate were/are blocking people from reprinting the issues, it's not because of copyright.

Also, keep in mind that there's no legal problem with claiming you own a copyright on something in the public domain.  And prior to all the records being put online, what layman would dare challenge a Cease and Desist from Will Eisner?  The common wisdom has always been that the creators would know better what they do and don't own.

I'm not saying he was defrauding people, by any means.  But I am saying that, for example, if he mistakenly confused copyrights with his trademark, no fanzine would challenge him on it.  That doesn't mean he had standing, though, if he took it to court.

I hope so too, Yoc. I love that so many more people can be exposed to The Spirit if it's available online. But to be honest, I don't see how it's NOT under copyright to Eisner's estate (or whoever). As far as I know, he never let the copyright lapse.

I just did a quick check of my copy of 1965 THE GREAT COMIC BOOK HEROES by Jules Feiffer, which was one of the first reprints of a Spirit story. Right along with all the other copyrights is Eisner's copyright on The Spirit. Starting with the Harvey reprints in 1966, The Spirit has been in print off-and-on since. Each time carrying Eisner's copyright.

Perhaps there's a loophole that I'm not aware of (a very distinct possibility--I'm not a copyright lawyer), but unfortunately, I kinda doubt it.

Sounds like we'll keep them online until someone can point to something conclusive.  If the Eisner estate contacts us we'll certainly read what they have to say with interest.

Probably worse that would (not could) happen is a cease and desist order. I would say that this overall group has been primary purchasers of the material reprinted even if available here. I think we could show that the site has probably done more to promote the sale of the reprint material, and increased those sales than decreased them.

Can you point me there?  As mentioned, when I looked, I only saw rare copyright statements (a requirement for copyright) and no renewals for Eisner (as a "contribution to periodicals") or as a "Spirit" periodical during the relevant renewal periods.

If you have something valid, it might mean that I looked in the wrong spot.  I'm OK being wrong on this, but without a paper trail, I don't see how this situation is different than "DC bought Fawcett, so none of those comics can be public domain--it just makes sense."
