Dr. Occult
« on: August 18, 2022, 04:46:03 PM »

Hi everyone!

I am working on a compilation of Dr. Occult appearances, and I was wondering if it would be allowed to post that compilation here.

The compilation only includes issues that are available to read on this site, as I downloaded them from this very platform (New Fun Comics #6, More Fun Comics #7-#32, The Comics Magazine #1).

But, given that the character is from DC Comics, I'm not certain about his rights' situation. Would it be possible to post a collection of his appearances on here?

I'm asking you because I'm not an expert on this matter, thanks a lot for your help!

As I understand it (and I am not a lawyer) those issues are here because the proper rights holder (Colonel Nicholson, I believe) did not renew them.

I believe there was a court ruling back in 1909 that a character went into the public domain when their first appearance went into the public domain. (Not that later appearances weren't protected.)

So I guess the main legal concern is whether or not the Dr. Occult name is trademarked by DC.

I suppose one could get around a name trademark by calling it "The Occult Investigator by Seigel and Shuster"?

Just my two cents (which may not be worth much these days.)

Back in the 80's Roy Thomas, as is his wont, as Roy is near-obsessed with Golden Age characters, when he was working for DC, re-introduced the character. He has been used infrequently since. So, I would imagine that DC now holds a renewed copyright?

Thanks for your help, guys!

On a more empirical note, it is allowed for me to post a "Dr. Occult Complete Collection" on here?
Or should I upload it with an alternate title that doesn't contain the words "Dr. Occult"?

The compilation won't include anyhting that is not on this site: all the pages will be from scans that are currently present on this platform.

I think you should go ahead with it.
Being a bit selfish here but I would read it.
