I'm a comic creator and I'm thinking about doing a Spirit book on my own. I can't figure out if it's just certain appearances of The Spirit or if the character himself is public domain because I'd Love to use the character that's been living rent free in my head for the past couple of week

the Spirit is NOT in the public domain.
i'm not an expert, but i believe that Eisner's family retains the rights to the character.

I would agree with twiztor that trying to do The Spirit would be playing with dynamite.

but it Won't be too long till the spirit himself enters PD only 12 years till he's been around for 95 years

Of course there are plenty of "open source" and PD alternatives to choose from. It all depends what you are going for. Will you be publishing your comic?
