Copyright status of "Magic Agent"?
« on: July 26, 2011, 04:05:32 PM »

Hi, I hope I'm asking this question in the right place.

I just got back from the San Diego Comic-Con, where I was able to pick up a few older titles for cheap. Of the Golden Age books I found, this site already has Buster Brown #30, and I assume the Dell/Walt Disney books would be off limits (Disney's lawyers don't seem the type to overlook copyright renewals).

That leaves me with the first issue of "Magic Agent", a 1962 comic by ACG. Can someone confirm the copyright status of this book? If it's public domain, I'd be happy to scan it for the "Silver Age Sidestreet" section of the site.

According to the PDSH.wikia.com site, "Only Magic Agent's self-titled series is in the public domain. His appearances in Unknown Worlds occurred after 1964 when renewal was no longer necessary to retain copyright."

I'm guessing that ties into the year the comics were released. I would direct you to http://digitalcomicmuseum.com/forum/index.php/topic,2452.0.html for a checklist for determining PD status.

You can also contact the guy who started this thread: http://goldenagecomics.co.uk/forum/index.php/topic,2999.0.html as he has offered to check on things like this. see http://goldenagecomics.co.uk/forum/index.php?action=profile;u=9773

Thanks guys. I'll look into it more, but if it's already been scanned elsewhere, I probably won't make it a top priority.

I will try to get confirmation that they are pd and then post them here. Just being on a wiki is not proof. If Wildthing can check the records for us we can know for sure.

I'd be also curious as to exactly what would be the cutoff for other ACG titles such as Adventures into the Unknown, Forbidden Worlds, Unknown Worlds and Herbie.  Maybe we could add some of the those issues from the early 1960s to the Silver Age Sidestreet section.

Best

I believe it is anything pre 1964 that was not renewed

Wasn't trying to say that. I provide the wiki as it's PD FAQ contains some helpful tools like the following:

http://www.librarycopyright.net/digitalslider/
and, as always

Kevin,

The magic agent series by acg  numbers 1 through 3 are within the public domain.  There are no current copyrights listed nor an application for their renewal.  However, as for the silver age releases in unknown..as someone stated and speculated,  they are absolutely under copyright.

Narf,

The majority of the things available for sale and trade that are about or include tailspin tommy are in the public domain, including, radio broadcasts and movies as well.  Oh, lets not forget his trading cards.... :)

But there's also the big question if post-1964 copyrights were registered - you still needed to register a copyright to protection. (and then there's the issue of registered copyright but malformed/missing notices,
which also would forfeit protection.)

Malformed or no copyright is how we get Charltons up to 1968
