Are those not in public domain or is there just no scans of them?

And is it common that some issues of comics here are not posted only because there are no scans yet of them?

Let's say a comic listed here says "available books 10" and "publication history 15 issues"...how would I know if the 5 not available are not in the public domain or are in the public domain but just not available because they have not been scanned?
