Are all of the post issue-#22 "Crime Does Not Pay" in the public domain?

A few are missing but my question is: Are the occasional unavailable issues such as 23, 24, 33, 36 etc.... solely unavailable because there are no scans or are they missing because they're not in the public domain?

They would be missing because they have not been scanned.
